This Privacy Policy explains how Porta (“Porta”, “we”, “our” or “us”) collects, uses, and shares information about you when you use our mobile apps, websites, and related services (collectively, the “Service”). By using Porta, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

We collect the following types of information:

1.1 Information You Provide to Us

• Account information: username, display name, email address, password, profile photo, bio, links, and other details you add.
• Content: photos, images, prompts, text, comments, likes, reactions, remixes, and any other content you create, upload, or share (including AI-generated content and edits).
• Photos and Face Data When you upload photos to Porta, they may include your face or other people’s faces (“Face Data”). We do not create or store biometric identifiers, faceprints, or detailed facial scans. We only work with the normal image files you choose to upload or create in the app.
• Communication: messages you send to us (support emails, feedback, bug reports) and any in-app communications where applicable.
• Participation in surveys, promotions, or beta programs: information you provide if you take part in research, surveys, or promotions.

1.2 Information We Collect Automatically

• Usage data: actions in the app (e.g., scenes viewed, creations made, templates used, likes, remixes, follows, time spent).
• Device and log information: IP address, device model, operating system, app version, language, time zone, identifiers (such as device IDs), crash logs, and diagnostic data.
• Cookies and similar technologies: to remember your preferences, keep you logged in, and measure performance.

1.3 Information from Third Parties

• Social or third-party login providers: if you sign in with Apple, Google, or others, we receive basic profile info (e.g., name, email) as permitted by those services.
• Analytics and measurement partners: aggregated or pseudonymized data on how users discover and use Porta.
• Payment processors / app stores: limited information related to purchases or subscriptions (no full payment card details are stored by us).

2. How We Use Your Information

We use the information we collect to:

• Provide, operate, and maintain the Service.
• Create and display your profile, content, and activity within the Service.
• Enable AI-powered features, such as generating or editing images and scenes using your inputs and content.
• Facilitate social features: following, feeds, comments, likes, remixes, and sharing.
• Personalize your experience (e.g., recommended scenes, creators, templates).
• Monitor and analyze usage and trends to improve Porta.
• Detect, prevent, and address fraud, abuse, or violations of our Terms of Service.
• Communicate with you about updates, security alerts, support, and administrative messages.
• Send you marketing communications (where permitted by law and your preferences).
• Comply with legal obligations and protect our rights.

How We Use Photos and Face Data

We use your photos, including any Face Data in them, only to provide Porta’s core features. This includes generating and editing images you request, and showing your photos and generated images back to you in the app. We do not use Face Data for facial recognition, identity verification, or targeted advertising, and we do not sell your Face Data.

We may use AI models and automated systems to process your content and activity, for example, to generate scenes, recommend content, detect spam or harmful behavior, or improve our models.

3. Legal Bases for Processing (EEA/UK Users)

• Contract: to provide you the Service you requested (e.g., when you create an account).
• Legitimate interests: such as improving the Service, securing our systems, and preventing abuse.
• Consent: for certain uses (e.g., some marketing, certain cookies). You can withdraw consent at any time.
• Legal obligation: where necessary to comply with applicable laws.

4. How We Share Information

4.1 With Other Users and the Public

• Your profile (username, avatar, bio, public stats).
• Your public content (scenes, images, prompts you mark as public, remixes) and associated metadata (likes, comments, remixes).
• If you remix or reuse someone else’s scene/template, we may show attribution (e.g., “Remixed from @username”).

You can control some visibility through in-app settings, but please remember that anything you make public can be viewed, shared, or saved by others.

4.2 Service Providers and Partners

We work with trusted third parties to help us run Porta for example:

• Cloud hosting, storage, and database providers (including Microsoft Azure, where we store your photos and generated images).
• AI/ML infrastructure and content processing providers (for example, image generation/editing providers that process your photos on our behalf).
• Analytics and measurement providers.
• Customer support and communication tools.
• Payment processors and app stores (for purchases and subscriptions).

Photos and Face Data with Service Providers

When needed to provide the Service, we may share your photos (which can include Face Data) with these providers so they can process images and run the features you request. They are only allowed to use your information to provide services to us and are not permitted to use your photos or Face Data to train their own public models, advertise to you, or sell your data. These providers are allowed to process your information onl to perform services on our behaif and are subject to safeguards.

4.3 Legal, Safety, and Rights

We may share information to:

• Comply with applicable laws, legal requests, or governmental demands.
• Enforce our Terms of Service.
• Protect the safety, rights, property, or security of Porta, our users, or others.
• Detect, prevent, or address fraud, security, or technical issues.

4.4 Business Transfers

If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will take steps to ensure your privacy rights are respected and notify you where required.

5. Data Retention

We keep information for as long as needed to:

• Provide the Service to You
• Comply with Legal, tax, or accounting requirement
• Resolve disputes and enfore our agreement

Photos, Face Data, and Deletion

We keep your photos and generated images, including any Face Data in them, for as long as they remain in your Porta account so we can provide the app’s features to you. You can delete individual photos or generated images at any time from within the app. If you delete your account, we delete or anonymize your personal information and associated photos from our active systems (subject to data we may need to retain for legal or legitimate business purposes). Some content (such as remixes that others have created from your original scenes) may remain visible if it has been reused by others, as allowed by the license you granted under our Terms. Any remaining copies in backups are removed automatically as those backups are cycled out.

6. Your Rights and Choices

Depending on your location you may have rights such as:

• Access: request a copy of the personal data we hold about you.
• Correction: ask us to correct inaccurate or incomplete data.
• Deletion: request deletion of your personal data in certain circumstances.
• Restriction: request restriction of processing in certain circumstances.
• Portability: request a machine-readable copy of your data.
• Objection: object to certain types of processing (e.g., direct marketing).
• Withdraw consent: where we rely on consent, you can withdraw it at any time.

You can exercise some of these rights via in-app settings.

Your Controls Over your Photos

You can delete your photos and generated images at any time inside Porta. When you delete content, we remove it from our active systems. If you delete your account, we also delete or anonymize your associated content, including Face Data, as described in the Data Retention section above. For other requests, please contact us at the email below. We may ask you to verify your identity before responding. If you are in the EEA/UK, you also have the right to complain to your local data protection authority.

7. Children’s Privacy

Porta is not directed to children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children under this age. If we learn that a child has provided us with personal information, we will take steps to delete it and may terminate the child’s account. If you believe a child has provided us with personal information, please contact us.

8. Security

We use reasonable technical and organizational measures to protect your information from unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. International Transfers

We may process and store your information on servers located in various countries. These countries may have data protection laws that are different from those in your country. Where required by law, we implement appropriate safeguards, such as standard contractual clauses or equivalent mechanisms, to protect your information when it is transferred internationally.

10. Third-Party Links and Services

The Service may contain links to third-party websites, apps, or services (e.g., app stores, social networks). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before using their services.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the “Last Updated” date and, where appropriate, through the app or by other means. Your continued use of Porta after the changes become effective signifies your acceptance of the updated Policy.
